1. Agreement to Terms

Welcome to Lunali Nail Supply (“Lunali,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at www.lunalinailsupply.com and any related online services, features, content, purchases, and transactions made through the website (collectively, the “Site”).

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Refund & Return Policy, and any other policies posted on the Site, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not access or use the Site.


2. Eligibility

By using the Site, you represent and warrant that:

  • you are at least 18 years old, or the age of majority in your jurisdiction;

  • you have the legal capacity to enter into a binding agreement; and

  • your use of the Site complies with all applicable laws, rules, and regulations.

We may refuse service, restrict access, suspend accounts, cancel orders, or block transactions at any time in our sole discretion, including where we suspect fraud, abuse, unauthorized resale activity, unlawful conduct, or violation of these Terms.


3. Accounts and Account Security

You may be required to create an account to access certain features of the Site. You agree to:

  • provide current, complete, and accurate account information;

  • maintain and promptly update your information;

  • keep your login credentials confidential; and

  • accept responsibility for all activity occurring under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not responsible for losses resulting from unauthorized access to your account caused by your failure to safeguard your credentials.


4. Products and Site Information

We attempt to display product descriptions, pricing, availability, colors, sizes, packaging, and other information as accurately as possible. However:

  • product images are for illustrative purposes only;

  • actual product colors, packaging, labeling, and appearance may vary;

  • product availability may change without notice; and

  • errors, inaccuracies, or omissions may occur.

We reserve the right to correct any error, inaccuracy, or omission and to update information or cancel orders arising from such errors, including after an order has been submitted.

5. Orders

a. Order Acceptance

Your order is an offer to purchase. We reserve the right to accept, reject, limit, or cancel any order for any lawful reason, including suspected fraud, product unavailability, pricing or listing errors, suspected resale abuse, shipping restrictions, or issues identified by our payment or fraud-screening systems.


b. Quantity Limits

We may limit quantities purchased per person, household, account, payment method, or order.


c. Order Changes and Cancellation

Once an order is submitted, changes or cancellation requests are not guaranteed. If we cancel an order after payment is captured, we will refund the amount actually paid to the original payment method unless otherwise required by law.


6. Pricing, Promotions, and Taxes

All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, bundles, and product availability are subject to change without notice.

Promotions may be subject to separate terms, expiration dates, item exclusions, minimum purchase requirements, one-time use limitations, or cancellation if used improperly.

You are responsible for applicable sales, use, shipping, handling, and other taxes or governmental charges unless expressly stated otherwise at checkout.


7. Payment

We accept payment methods made available on the Site. By submitting payment information, you represent and warrant that:

  • you are authorized to use the payment method provided; and

  • the billing information you provide is true and accurate.

Payments may be processed by third-party payment processors. We do not store full payment card information on our servers. Your payment transaction may be subject to the terms and privacy policies of the applicable third-party processor.

We reserve the right to refuse or cancel transactions that appear fraudulent, unauthorized, suspicious, or inconsistent with these Terms.


8. Shipping, Delivery, Title, and Risk of Loss

a. Shipping Times

Any shipping or delivery dates provided on the Site, in checkout, or in order communications are estimates only unless expressly stated otherwise. We do not guarantee delivery by any specific date.


b. Shipment Delays

Delays may occur due to carrier issues, weather, supply disruptions, high order volume, holidays, address verification issues, or events outside our reasonable control.


c. Customer Address Responsibility

You are responsible for providing a complete and accurate shipping address. We are not responsible for losses, delays, or extra costs caused by incorrect, incomplete, or undeliverable address information provided by you.

d. Title and Risk of Loss

Title to products passes to you upon our transfer of the products to the carrier, and risk of loss or damage passes to you at that time, to the fullest extent permitted by law.


e. Lost, Damaged, or Stolen Packages

If a package is lost, damaged, or missing, you must contact us within 5 calendar days of the marked delivery date or attempted delivery date and provide any reasonably requested documentation, including photographs, carrier notices, or claim information.

Where applicable, we may assist with carrier claims, but we do not guarantee claim approval. Packages marked by the carrier as “delivered” may not be eligible for replacement or refund, except as required by law or expressly approved by us in writing.


9. Returns, Refunds, and Exchanges

Your purchase is subject to our Refund & Return Policy, which is incorporated into these Terms by reference.

Unless otherwise required by law or expressly stated in our Refund & Return Policy:

  • all sales are final;

  • returns are accepted only for eligible items and only in accordance with our posted policy;

  • unauthorized returns may be rejected and returned to sender at the sender’s expense;

  • original shipping charges are nonrefundable unless required by law or due to our error; and

  • refunds, if approved, are issued to the original payment method within a commercially reasonable period.

 

10. Professional Use; Product Safety; User Responsibility

Certain products sold on the Site may be intended for professional or trained use only. You are solely responsible for:

  • determining whether a product is appropriate for your intended use;

  • reading and following all product labels, warnings, instructions, ingredients, and manufacturer guidance;

  • conducting any recommended patch tests or safety tests before use;

  • using products only in accordance with applicable laws and industry safety standards; and

  • storing, handling, and disposing of products properly.

To the fullest extent permitted by law, we are not liable for injuries, reactions, damages, or losses arising from misuse, improper storage, failure to follow instructions, failure to review ingredient information, or use inconsistent with the product’s intended purpose.


11. Prohibited Conduct

You agree not to:

  • use the Site for any unlawful, fraudulent, deceptive, or abusive purpose;

  • interfere with the operation, security, or functionality of the Site;

  • scrape, crawl, copy, reproduce, republish, or exploit Site content without our prior written consent;

  • upload malicious code, viruses, or harmful data;

  • attempt unauthorized access to any account, system, or network;

  • impersonate another person or misrepresent your affiliation; or

  • use the Site in a way that could damage, disable, overburden, or impair the Site or our business.

We may investigate suspected violations and cooperate with law enforcement or other authorities where appropriate.


12. Intellectual Property

All content on the Site, including text, graphics, logos, icons, product photographs, videos, software, page layouts, compilations, and other materials, is owned by Lunali Nail Supply or its licensors and is protected by intellectual property and other applicable laws.

Except as expressly permitted in writing, you may not use, reproduce, distribute, modify, display, publish, create derivative works from, sell, or exploit any Site content.


13. Third-Party Services and Links

The Site may contain links to third-party websites, applications, platforms, or services, including payment processors, social media platforms, or shipping carriers. We do not control and are not responsible for third-party content, policies, terms, acts, or omissions. Your use of third-party services is at your own risk and subject to those third parties’ own terms and policies.


14. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ALL CONTENT, AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUNALI NAIL SUPPLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND THE IMPLIED WARRANTY OF NON-INFRINGEMENT.

We do not warrant that:

  • the Site will be uninterrupted, timely, secure, or error-free;

  • defects will be corrected;

  • the Site or servers are free of viruses or harmful components; or

  • products, descriptions, content, or other materials will always be accurate, complete, reliable, or current.

Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.


15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUNALI NAIL SUPPLY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE, ANY ORDER, ANY PRODUCT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, ANY ORDER, ANY PRODUCT, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain disclaimers or limitations, so portions of this section may not apply to you.


16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Lunali Nail Supply and its owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your use of the Site;

  • your breach of these Terms;

  • your violation of any law or the rights of any third party; or

  • your misuse of any product purchased from us.

 

17. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

a. Informal Resolution

Before initiating arbitration or filing a claim, you agree to first contact us in writing at info@lunalinailsupply.com and provide a brief description of the dispute and your requested resolution. The parties agree to attempt in good faith to resolve the dispute informally for at least 30 days after notice is received.


b. Binding Arbitration

Except for claims that may be brought in small claims court and claims seeking injunctive or equitable relief relating to intellectual property or unauthorized access to the Site, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, any order, or any product purchased from us shall be resolved by final and binding arbitration on an individual basis.

The arbitration shall take place in New Jersey, unless otherwise required by applicable law. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, enforceability, or applicability of this arbitration provision, except issues relating to the class action waiver below, which shall be decided by a court of competent jurisdiction.


c. No Class Actions

YOU AND LUNALI NAIL SUPPLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, OR PRIVATE ATTORNEY GENERAL IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

d. Severability

If any part of this Section 17 is found unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law, except that if the class action waiver is found unenforceable, then this Section 17 shall be unenforceable in its entirety to that extent.


18. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Site, or any purchase from us shall be governed by the laws of the State of New Jersey, without regard to conflict of law principles, except to the extent preempted by federal law or otherwise required by applicable consumer protection law.


19. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, labor disputes, supply shortages, carrier interruptions, governmental actions, power failures, telecommunications failures, cyber incidents, epidemics, pandemics, or platform outages.


20. Electronic Communications

By using the Site, creating an account, or placing an order, you consent to receive communications from us electronically, including by email, website notices, or other electronic means, and you agree that such communications satisfy any legal requirement that communications be in writing.


21. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on the Site with a revised “Last Updated” date. Changes will become effective upon posting unless otherwise stated. Your continued use of the Site after the effective date of the revised Terms constitutes your acceptance of the updated Terms.


22. Severability; No Waiver; Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms shall not operate as a waiver of that provision or any other provision.

These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and Lunali Nail Supply regarding the Site and supersede prior or contemporaneous understandings relating to the same subject matter.
